Terms of Service
Last Updated: April 27, 2025
Welcome to Typeshutter, a creative content platform provided by Typeshutter LLC ("Operator," "we," or "us"). These Terms of Service ("Terms") govern your access to and use of the Typeshutter website, applications, and services (collectively, the "Service" or "Services"). By creating an account or using the Service in any manner, you ("User" or "you") agree to be bound by these Terms. If you do not agree, you must not use Typeshutter.
Please read these Terms carefully. They include important legal obligations and rules about content on the platform. All content shared on Typeshutter must comply with these Terms and our content rules outlined below.
1. Acceptance of Terms
By accessing or using Typeshutter, you acknowledge that you have read, understood, and agree to these Terms, as well as our Privacy Policy and any other guidelines or policies referenced herein (collectively, the "Agreement"). This Agreement constitutes a binding legal contract between you and the Operator. We reserve the right to update or modify these Terms from time to time. We will indicate the date of the latest revision at the top of this document. Your continued use of the Service after any changes signifies your acceptance of the revised Terms. If you do not agree to the Terms or any updated version of them, you must stop using the Service.
2. Eligibility
Age Requirement: You must be at least 18 years old to register for and use the Typeshutter Service. By using Typeshutter, you represent and warrant that you are 18 or older, or the age of majority in your jurisdiction. We do not knowingly allow individuals under 18 to create accounts or access the Service. If you are under 18, do not use or access Typeshutter.
If you are using the Service on behalf of an organization or entity, you further represent that you have the authority to agree to these Terms on its behalf, and that the entity accepts this Agreement.
3. User Accounts and Security
To access certain features of Typeshutter, you will need to create an account. When creating an account, you agree to provide accurate, current, and complete information and to keep this information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You should choose a strong, secure password and not share it with others. If you suspect any unauthorized use of your account or any security breach, you must notify us immediately at support@typeshutter.com. We are not liable for any loss or damage arising from your failure to secure your account.
4. User Content and Ownership
Your Content: Typeshutter allows you to create, post, and share content, including but not limited to text, images, designs, and other materials (collectively, "User Content"). You retain any intellectual property rights you hold in the content you create and share on Typeshutter. By uploading or posting User Content on the Service, you grant the Operator a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify (for technical adaptations like resizing or reformatting), display, distribute, and publicly perform your content solely for the purpose of operating, marketing, and improving the Service. This license enables us to display your content on your portfolio and in other areas of the platform, and to promote Typeshutter (for example, by featuring thumbnails of your public content).
Public Portfolios: Unless you choose privacy settings that restrict visibility (if such settings are available), content that you share or post to your Typeshutter portfolio or public areas of the Service will be visible to others. By posting content on your public portfolio, you acknowledge that anyone (including visitors who are not registered users) may view that content, subject to any content warning or restricted visibility features we may implement. If you have content that you prefer not to be publicly accessible, please adjust your sharing settings accordingly or refrain from posting such content in public sections of the Service.
Your Responsibilities: You are solely responsible for all User Content that you create, upload, publish, or share on Typeshutter. This means you assume all risks related to that content, including anyone else's reliance on its accuracy, or claims relating to intellectual property or other legal rights. By posting content, you represent and warrant that: (a) you own or have the necessary rights to post the content and to grant us the license described above; (b) the posting of your content on the Service does not violate any rights of any third party (for example, it does not infringe copyright, trademark, privacy, or publicity rights); and (c) your content and its use on the Service comply with these Terms and all applicable laws.
We do not claim ownership of your content, and nothing in these Terms will be construed to restrict your rights to use and exploit your own content outside of the Service. You have the right to remove your content from Typeshutter at any time. However, note that even if you delete content or terminate your account, we may retain copies for backup, archival, or legal purposes as permitted by law.
5. Content Rules and Community Guidelines
Typeshutter is a creative community that values freedom of expression. We permit a wide range of content as long as it does not violate the law or this Agreement. However, to keep our platform safe and legal, you agree that you will not post or share any content that:
-
Violates the Law or Rights of Others: Do not post content that is illegal, fraudulent, or that promotes any illegal activities. This includes content that infringes or misappropriates someone else's copyright, trademark, or other intellectual property rights, or that violates privacy, data protection, or publicity rights of others. You must only upload content that you have the right to share.
-
Involves Exploitation or Harm to Minors: Any content depicting or describing minors (under 18 years old) in a sexual, violent, or abusive manner is strictly prohibited. You may not use Typeshutter to create or share content that sexualizes minors or in any way exploits children. We have zero tolerance for child sexual exploitation. If we become aware of any such content, we will remove it and may report it to law enforcement.
-
Is Non-Consensual or Illegal Sexual Content: You may not post any content depicting sexual activities that are non-consensual, exploitative, or otherwise illegal (for example, rape, sexual assault, or bestiality). Content involving unlawful conduct is not permitted.
-
Is Violent or Graphic in a Harmful Way: You may share art or content that includes violence or graphic imagery (for example, in storytelling or artistic contexts), but you must not post excessively gruesome or gratuitous violence primarily intended to shock or glorify violence. Any content that encourages violence or incites harm toward anyone is forbidden. If you post graphic content that could be considered sensitive (e.g., depictions of violence, gore, or other disturbing themes), you should appropriately label it as such if the feature exists, so that users are warned.
-
Harasses, Threatens, or Hates: Do not share content that is defamatory, harassing, bullying, or that promotes bigotry, hatred, or violence against any individual or group. This includes content that attacks or demeans someone based on characteristics such as race, ethnicity, national origin, religion, sex, gender, sexual orientation, disability, or medical condition. Hate speech and threats of violence are strictly forbidden.
-
Is Inappropriate for Public-Facing Areas: Content used in highly visible areas—such as your user profile picture, cover banner, or promotional thumbnails—must remain appropriate for general audiences. Do not use imagery in these spaces that would violate these Terms or applicable law.
-
Is Spam, Malware, or Deceptive: Do not post unsolicited advertisements, junk content, or repetitive spam. You also must not upload viruses, malicious code, or do anything that could disrupt or harm the operation of the Service or other users' devices.
-
Impersonates or Misleads: You must not impersonate any person or entity or misrepresent your affiliation with anyone. Do not post content that is intentionally false or misleading (like hoaxes, phishing attempts, or scams) in ways that could harm others. Parody or satire must be clearly identified to avoid confusion.
-
Violates Privacy or Personal Data: You should not post personal information about another person (for example, someone's home address, phone number, email, financial information, or other sensitive data) without their consent. In particular, do not share intimate images or information of others without permission (sometimes known as "doxxing" or, in the case of images, "revenge porn"). Non-consensual sharing of someone's private content is prohibited.
These content rules apply to all content you submit, upload, create, or share on Typeshutter. By using the Service, you understand and accept that you are responsible for your interactions with material created by other users. We provide tools such as content warnings or filters to help users avoid content they find objectionable, and we reserve the right to label or restrict access to content (for example, by placing it behind a click-through warning or disabling it for users who opt out of seeing certain material). Users are expected to properly tag or label their content if such features are available, to alert others when material may not be suitable for all audiences. Failure to comply with these content rules or labeling requirements can result in removal of content or suspension of your account.
6. Platform Moderation and Enforcement
No Pre-Screening: Typeshutter does not systematically pre-screen all user content. However, we (and our designees) have the right, but not the obligation, to review, monitor, and remove any User Content at our discretion. If content is reported to us or flagged as potentially violating these Terms (including the Content Rules above), we may examine it and take appropriate action. This can include removing or disabling access to the content and/or terminating the account of the user responsible, as described in Section 7 (Termination). We may also edit or remove any content that, in our judgment, violates these Terms or is otherwise objectionable or inappropriate, without prior notice to you.
Content Reporting: The community is encouraged to report content that appears to violate these Terms or our policies. If you come across content that you believe is not allowed, please inform us through the reporting mechanisms on the platform or contact us at support@typeshutter.com. We will review reports and address them in accordance with our guidelines and applicable law.
Restricted Visibility: We may restrict the visibility of certain content to specific users or areas. For example, some content might be hidden from users who are not logged in, or displayed with interstitial warnings (e.g., "This content may not be suitable for all audiences") that require viewers to confirm they wish to proceed. By posting content, you acknowledge and agree that Typeshutter may apply these measures to your content to protect users who do not wish to see particular material. Nonetheless, any content you post publicly is potentially accessible to others who choose to view it, and we cannot guarantee that all unauthorized access (for example, by determined minors falsifying their age) will be prevented. Use discretion when sharing material publicly.
7. Termination of Use
We reserve the right to suspend or terminate your Typeshutter account or access to the Service at any time, with or without notice, if we believe that: (a) you have violated any provision of these Terms or any policy of ours; (b) your conduct is harmful to the Operator, our community, or third parties; or (c) we are required to do so for legal reasons. We may also remove or disable access to any of your content that violates these Terms or that we deem objectionable, at our sole discretion.
If your account is terminated, you remain bound by this Agreement to the extent applicable (for example, our rights concerning previously-posted content and any indemnification obligations you owe). You may also terminate your own account at any time if you no longer wish to use the Service. To do so, you can follow the account deletion process in your account settings or contact us at support@typeshutter.com for assistance. Termination of your account will result in the deactivation or deletion of your profile and access to it, and the removal of your User Content from the active portions of the Service. However, please note that residual copies of your content and account information may continue to exist on our backup and archival systems for some time and as required to comply with legal obligations.
8. Licenses and Intellectual Property Rights
Our Content: Except for your User Content, all content and materials available through Typeshutter, including but not limited to software, code, the platform's design, text, graphics, logos, trademarks, service marks, and any other intellectual property (collectively, "Typeshutter Content"), are owned by the Operator or our licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service and Typeshutter Content for your personal, non-commercial use in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of our proprietary content or software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws permit it or we give you our written permission.
Feedback: If you choose to provide feedback, suggestions, or ideas regarding Typeshutter or our Services ("Feedback "), you agree that we are free to use such Feedback for any purpose, without restriction or compensation to you, and you acknowledge that we have no obligation to keep that Feedback confidential.
Third-Party Content: Typeshutter may contain links to third-party websites or services, or incorporate content provided by third parties (for example, a library integration or third-party plugins). We do not endorse or assume any responsibility for any such third-party sites, information, materials, or services. If you access a third-party website or content from Typeshutter, you do so at your own risk, and you understand that this Agreement and our policies do not apply to those external sites. Be sure to review any third-party terms and privacy policies before using their services.
9. Disclaimers of Warranties
Typeshutter is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, the Operator and any contractors or service providers working with us disclaim all warranties, express or implied, in connection with the Service and your use of it. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components (like viruses).
Specifically, we make no warranty or representation regarding:
-
Content: The accuracy, quality, or reliability of any content (including User Content) posted on the platform. You understand that by using Typeshutter, you may encounter content that is inaccurate, offensive, or indecent. You view such content at your own risk. We are not responsible for any harm or losses resulting from your exposure to user-submitted content.
-
Security: The security of our Service. While we implement reasonable security measures, we do not warrant that unauthorized parties will never be able to bypass those measures or use your personal information for improper purposes. You provide your information at your own risk.
-
Fitness for Purpose: Any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that Typeshutter will meet your specific requirements or achieve any intended results.
No advice or information, whether oral or written, obtained by you from us or through the Service shall create any warranty not expressly stated in these Terms.
10. Limitation of Liability
To the maximum extent permitted by applicable law, the Operator (and any officers, directors, employees, agents, or contractors acting on our behalf) shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from: (a) your access to or use of (or inability to access or use) the Service; (b) any conduct or content of any third party on the Service, including any offensive, illegal, or infringing content; (c) unauthorized access, use, or alteration of your transmissions or content; or (d) any other matter relating to the Service.
In no event shall our total liability for all claims related to the Service exceed the amount you paid to us (if any) in the past six (6) months for the specific Service at issue. Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you to the extent prohibited by law. In such cases, our liability will be limited to the minimum extent permitted by law.
11. Indemnification
You agree to indemnify, defend, and hold harmless the Operator and any affiliates, officers, agents, partners, contractors, and employees from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees and costs) that arise out of or relate to: (a) your use or misuse of the Service; (b) your violation of any term of this Agreement; (c) your violation of any rights of a third party, including any intellectual property, confidentiality, property, or privacy right; or (d) any dispute you have with another user or third party relating to your use of the Service. We reserve the right to handle our legal defense as we see fit, including choosing our counsel, and you agree to cooperate with us in the event of any claim requiring your participation.
12. Governing Law and Dispute Resolution
These Terms and any action related thereto will be governed by and interpreted in accordance with the laws of the United States and, where applicable, the laws of the jurisdiction where the Operator resides, without regard to conflict-of-law principles. You agree that any disputes arising from or relating to these Terms or your use of the Service will be subject to the exclusive jurisdiction of courts located within the United States that have appropriate subject-matter jurisdiction. You consent to such jurisdiction and venue, and you agree that we may seek injunctive or equitable relief in any court of competent jurisdiction as needed to protect our rights.
Arbitration (Optional): If we mutually agree in writing, you and the Operator may resolve any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Service through binding arbitration administered by a recognized arbitration provider. Unless we both agree otherwise, arbitration proceedings will be conducted remotely or in a manner that does not require either party to travel. Any arbitration will be conducted on an individual basis, and not as a class or collective action.
13. Changes to the Service
We reserve the right to modify, suspend, or discontinue any part of the Typeshutter Service at any time, with or without notice. This includes adding or removing features, imposing limits on certain features, or restricting access to parts or all of the Service. We are not liable to you or any third party for any such modification or discontinuation. We will, however, endeavor to notify users of any major changes that significantly affect the usage of the platform. Your continued use of the Service after changes become effective constitutes your acceptance of those changes.
14. Miscellaneous
Entire Agreement: These Terms (along with any incorporated policies or guidelines, such as our Privacy Policy and Content Rules) constitute the entire agreement between you and the Operator regarding your use of Typeshutter. They supersede any prior agreements or communications between you and us concerning the Service.
Waiver and Severability: Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision. If any provision of these Terms is held by a court of competent jurisdiction to be invalid or unenforceable, the remainder of the Terms will remain in full force and effect, and the invalid provision will be deemed modified so that it is valid and enforceable to the maximum extent permitted by law.
Assignment: You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may freely assign or transfer this Agreement (in whole or in part) as part of a merger, acquisition, sale of assets, or by operation of law or otherwise. These Terms will bind and inure to the benefit of each party's successors and permitted assigns.
No Third-Party Beneficiaries: This Agreement is for the benefit of you and the Operator (including our successors and permitted assigns), and does not create any rights for any third parties.
Headings: Section headings in these Terms are for convenience only and have no legal or contractual effect.
